กรณีมีมติสภาความมั่นคงแห่งชาติ (สมช.) เห็นชอบให้ยกเลิก MOU 44 โดยจะใช้กลไกอนุสัญญาสหประชาชาติว่าด้วยกฎหมายทางทะเล (UNCLOS) แทน และสถานการณ์ความมั่นคงทางพลังงานบริเวณอ่าวไทยในอนาคต
