1. Respect for Intellectual Property
OndaCast respects the intellectual property rights of others and expects all users of the OndaCast Service to do the same. It is our policy to respond expeditiously to claims of copyright infringement reported to our Designated Copyright Agent identified below, in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA").
OndaCast reserves the right to disable and/or terminate the accounts of users who are repeat infringers of the copyrights of others.
2. Copyright Ownership
The OndaCast Service, including its user interface, visual design, source code, logos, graphics, icons, and branding, is the property of OndaCast and is protected by copyright, trademark, and other intellectual property laws of the United States and other countries. All rights not expressly granted in these terms are reserved.
The OndaCast name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of OndaCast. You may not use these marks without our prior written permission.
3. Third-Party Content
OndaCast is a media aggregator that indexes and provides access to third-party content. The following types of content are owned exclusively by their respective creators, broadcasters, and rights holders:
- Radio Streams: Live radio broadcasts are produced and owned by the respective radio stations and broadcasting organizations. OndaCast links to publicly available streams but does not host, store, or redistribute the audio content.
- Podcast Episodes: Podcast content is created and owned by the respective podcast producers, hosts, and networks. OndaCast indexes publicly available podcast RSS feeds and links to episodes hosted on their original platforms.
- Audiobook Content: The audiobooks available through OndaCast are public domain works sourced from the Internet Archive (archive.org). Most audiobooks are narrated by volunteers through the LibriVox project. OndaCast is not the creator, narrator, producer, or host of any audiobook content — we function solely as a directory that facilitates access to these freely available public domain recordings streamed directly from the Internet Archive's servers. OndaCast assumes no responsibility or liability for errors, omissions, inaccuracies, or quality issues in the narration or audio production. The Internet Archive's and LibriVox's own terms of use apply to all audiobook content.
- TV Streams: Live TV broadcasts are produced and owned by their respective networks and broadcasters.
OndaCast does not claim any ownership over third-party content. OndaCast does not host, store, copy, or redistribute any audio or video files. Our service functions exclusively as a directory and discovery tool that links users to content published and hosted by third parties on their own servers and platforms.
4. Station Logos & Metadata
OndaCast displays station logos, names, descriptions, and other metadata to help users identify and discover radio stations, podcasts, and other content. This information is sourced from publicly available APIs, station websites, and public directories.
Station logos and metadata are used under fair use principles for the purpose of identification, commentary, and facilitating access to the stations' publicly available streams. OndaCast does not claim ownership of any station logos or branding.

5. User-Generated Content
Users retain full ownership of the content they create on OndaCast, including comments, reviews, ratings, and curated collections. By posting content on OndaCast, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content solely in connection with operating and providing the OndaCast Service. For full details on this license, please refer to our Terms of Service.
6. Filing a DMCA Notice
If you believe that content available through the OndaCast Service infringes a copyright you own or control, you (or your authorized agent) may submit a Notice of Alleged Infringement ("DMCA Notice") to our Designated Copyright Agent listed below. Your DMCA Notice must include the following:
- Identification of the copyrighted work(s): A description of the copyrighted work you claim has been infringed, including registration numbers if available. If multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: The URL(s) or other specific identification of the material on OndaCast that you claim is infringing, with sufficient information to enable us to locate the material.
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- Good-faith statement: A statement substantially as follows: "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
- Accuracy statement under penalty of perjury: A statement substantially as follows: "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Upon receiving a valid and complete DMCA Notice, OndaCast will use its discretion to determine the appropriate response, which may include removal of, or disabling access to, the challenged material.
7. Counter-Notification
If you believe that content you posted on OndaCast was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent with the following information:
- Identification of the content that was removed and the location at which the content appeared before it was removed or disabled
- A statement, under penalty of perjury, that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification of the content to be removed or disabled
- Your full legal name, mailing address, telephone number, and email address
- A statement that you consent to the jurisdiction of the federal court located in Lake County, Ohio (or, if you are located outside the United States, any judicial district in which OndaCast may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person
- Your physical or electronic signature
Upon receiving a valid counter-notification, we will forward it to the party who filed the original DMCA Notice. If the original complainant does not file a court action seeking an order against you within ten (10) to fourteen (14) business days after receiving the counter-notification, we may, in our discretion, restore the removed content.
8. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, OndaCast has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the OndaCast Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
